In May 2007, Chinese State Administration of Foreign Exchange (SAFE) released new policies pivotal to international financing transactions. SAFE Implementation Notice 106 further defines the operational directives of SAFE Circular 75, governing special purpose companies formed to carry out offshore financings of Chinese controlled assets. The expanded rules impart additional hurdles for Chinese-owned companies seeking international capital as well as for U.S. investors.
